Terms of Use

By accessing or using the SpinGlobus website, mobile applications, APIs or any services made available by SpinGlobus (together, the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service. If you use the Service on behalf of a business or organization, you represent that you are authorized to bind it and that it accepts these Terms.

You own your photos and trips; we need a limited license to host and technically process them. You control visibility (public / link-only / private). Public items can be seen, reshared and indexed. We follow EU Digital Services Act procedures (reporting, statements of reasons, appeals). Subscriptions auto-renew unless you cancel; EU consumers generally have a 14-day withdrawal right (with statutory exceptions). We process personal data, including precise location you choose to upload, under GDPR as described below.

1. Who we are & contacts

1.       The Service is provided by SpinGlobus.com ("SpinGlobus", "we", "us"). These Terms govern your use of the Service.

2. Eligibility & accounts

1.       Minimum age: You must be at least 15 years old to use the Service. Local rules may require a higher age in some countries.

2.       Provide accurate information, keep your password secure, and do not share credentials. You are responsible for activities under your account.

3.       Accounts are personal and non-transferable. Do not impersonate others or create accounts for others without permission.

3. Your content & visibility

1.       Content: photos, albums, trips, comments, tags, names, timestamps and precise GPS/location data (including EXIF metadata) you upload or create in the Service.

2.       Ownership: You retain ownership of your Content.

3.       License to SpinGlobus: You grant a non-exclusive, worldwide, transferable, sublicensable, royalty-free license to host, store, reproduce, transcode/format, display and distribute your Content solely to operate, secure, improve and provide the Service, including your chosen sharing options (public / friends / link / e-mail / oEmbed / API). We do not sell your Content or license it to third parties for advertising without your explicit opt-in. Upon deletion of Content or account, this license ends except as reasonably necessary for backups, legal obligations and disputes; caches/CDNs are purged using reasonable efforts within 30–90 days.

4.       Privacy settings: You control visibility (Public, link-only, Private). Public Content may be indexed by search engines and reshared by third parties.

5.       EXIF/GPS caution: photos may contain precise time/location in EXIF. Publishing location can reveal sensitive patterns (home, school routes). You are responsible for what you disclose.

6.       Third-party rights: Upload only content you have rights to; obtain consents for identifiable persons (especially minors).

7.       Not a backup: Keep your own copies; the Service is not a backup repository.

4. Acceptable use (prohibited activities)

§   Illegal content, terrorism, CSAM, incitement to violence/hatred; IP infringement, defamation, doxxing or unlawful disclosure of personal data.

§   Pornography or sexually explicit content, especially where any person appears or could appear under 18; glorification of self-harm or dangerous activities.

§   Spam, fraud, phishing, malware; unauthorized scraping, crawling, automation or bulk downloads; attempts to bypass security or overload the Service.

We may remove content, limit functions, suspend or terminate accounts where we reasonably suspect breach of these Terms or law.

5. DSA: reporting, reasons, appeals & out-of-court settlement

1.       Report illegal content: e-mail [email protected] with reason, exact URL/ID, contact (optional) and a good-faith accuracy statement. Trusted-flagger notices may be prioritized where applicable.

2.       Statement of reasons: if we restrict/remove content or accounts, affected users receive a statement of reasons without undue delay (action taken, legal/policy basis, appeal options, automation if used).

3.       Internal appeal: appeal within 6 months via account tools or [email protected]. We aim to decide within 14 days (longer where reasonably necessary).

Out-of-court dispute settlement: you may turn to a certified DSA out-of-court dispute settlement body in your country. Court action remains available.

6. SpinGlobus IP & brand

The Service, databases, software and SpinGlobus-created content are protected by law. No license is granted beyond normal use. Do not use SpinGlobus names, logos or trade dress without prior written permission.

7. Copyright/IP notices

To notify an infringement, e-mail [email protected] with: (a) identification of the work; (b) exact links/IDs; (c) your contact; (d) a good-faith statement of authority and accuracy. We may disable access and notify the uploader, who may submit a counter-notice.

8. Subscriptions (plans), trials, auto-renewal, cancellations

We offer plans (e.g., Free, Pro) with limits and prices shown in your account. Subscriptions auto-renew until you cancel. Trials, if any, convert to paid unless cancelled before they end. EU consumers have a 14-day withdrawal right; if you explicitly request immediate start and acknowledge loss of that right to the extent supplied, service starts immediately and withdrawal will not apply to the supplied part. Prices may include/exclude VAT; VAT is charged per your location. Failed payments may lead to downgrades or cancellation. Fees are non-refundable unless required by law. Price changes apply at next renewal after prior notice; annual plans receive a renewal reminder equall or more than 30 days prior. Upgrades may be prorated; abusive chargebacks may result in account limits or suspension.

9. One-off purchases (e.g., photo albums) & digital a-la-carte items

Orders: your order is an offer; we accept by shipping/acceptance e-mail or by delivering a digital item. We may refuse/cancel for reasonable grounds (pricing/stock errors, suspected fraud, delivery restrictions, failure to pay). Pricing & taxes: as displayed at checkout; obvious errors are not binding. Delivery/risk (goods): risk passes on delivery; inspect promptly. Digital items: access by download/account; do not re-sell/share beyond license. EU withdrawal (goods): 14 days from delivery except goods made to your specifications or clearly personalized (e.g., a photo book from your photos), which are not returnable unless defective. EU withdrawal (digital): 14-day right ends once delivery begins with your prior express consent and acknowledgment. Conformity & updates: statutory consumer rights apply; we provide required security/functionality updates. Production tolerances & proofs: industry-standard variations (color/trim); proof approval = acceptance of layout/content. Delays: delivery times are estimates; we are not liable for carrier/customs/force-majeure delays. Remedies: confirmed defects may be remedied by reprint or refund.

10. Privacy, GDPR & cookies

Controller: SpinGlobus is the controller for personal data processed to operate the Service; for some integrations we may act as a processor. Contact: [email protected].

What we collect

§   Account data (e-mail, username, password, optional profile).

§   Content & metadata (photos, albums, trips, comments, tags, EXIF/GPS, timestamps).

§   Usage/logs (IP, device/browser, pages, clicks, referral/exit URLs, identifiers, diagnostics).

§   Payments (billing details, transaction IDs processed by our payment providers – no full card numbers stored by us).

§   Communications (support, moderation records including DSA statements of reasons).

Purposes & legal bases

Provide the Service (contract); security/abuse prevention (legitimate interests/legal obligations); analytics & improvement (legitimate interests; consent where required); marketing (consent; withdraw anytime); legal compliance (obligations).

International transfers

Your data may be stored and processed in any country where we or our providers, affiliates, backups or CDN/edge nodes operate. We cannot guarantee data will remain in a particular country/region at all times. For transfers outside the EEA we use appropriate safeguards (e.g., Standard Contractual Clauses) and perform transfer assessments; where required, we apply additional measures or restrict features/regions.

Cookies & similar technologies

§   Necessary (auth, security, cart/checkout) – always on.

§   Functional (preferences, media rendering); Analytics (traffic/performance); Advertising (if used – disabled by default in the EU unless you consent). Manage via cookie banner/browser settings.

Retention, security & rights

We keep data while your account is active and as required by law; use reasonable technical/organizational measures; no system is perfectly secure. You have rights of access, rectification, erasure, restriction, portability, objection and to withdraw consent; you can complain to your supervisory authority (CZ: ÚOOÚ).

Children: we do not knowingly collect data from persons under 15; if you believe a child has provided data, contact us for deletion.

11. Availability, changes & termination

The Service is provided "as is" and "as available". We strive for high availability but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue features or the Service; for material adverse changes we will give reasonable prior notice (e.g., in-app or e-mail). You may delete your account at any time. We may limit availability to any person/region to comply with law or for business reasons. You are responsible for mobile/data charges.

12. Disclaimers & limitation of liability

Carve-outs: nothing excludes/limits liability for death/personal injury; intentional misconduct or gross negligence; your statutory consumer rights (incl. remedies for non-conformity of goods/digital content/services); GDPR compensation; or fraud.

B2B users: subject to the carve-outs, our total aggregate liability arising out of the Service is limited to the fees you paid to us in the 12 months before the event. Consumers: where permitted by law and excluding the carve-outs, our total aggregate liability for losses other than your statutory remedies is limited to the fees you paid to us in the 12 months before the event.

13. Governing law, courts & ADR

These Terms are governed by the laws of the Czech Republic (conflict rules excluded). Consumers: you retain mandatory rights and may bring disputes before competent courts; national ADR bodies may be available (e.g., ÈOI). Business users (B2B): exclusive jurisdiction lies with the courts in Prague, Czech Republic; parties may agree in writing to institutional arbitration for B2B disputes. Content-moderation disputes: see Section 5 (DSA out-of-court options).

14. Changes to these Terms

We may update these Terms. For material changes, we will notify you at least 15 days before they take effect so you may review or terminate your use. Continued use after the effective date constitutes acceptance.

15. APIs, scraping & export control

Access to non-public interfaces, scraping/crawling and bulk downloads without our permission are prohibited. Public APIs, if offered, are governed by separate API terms. You must comply with applicable export-control and sanctions laws and may not use the Service where prohibited.

16. Final provisions

Invalidity of any provision does not affect the remainder; such provision is replaced by one closest to its purpose. Failure to enforce is not a waiver. You may not assign these Terms or rights without our prior written consent; we may assign to an affiliate or successor. These Terms are issued in English.

Effective date: 1 January 2025. This version supersedes prior versions.

Annex A – Minimum content-moderation standards (extract)

Combination of user reports, human review and technical tools; least intrusive measures where feasible; automated filters on public content (e.g., nudity/CSAM detection) with option to request human review; proportionate, graduated sanctions for repeat violations.

Annex B – EU consumer withdrawal information

Subscriptions/digital items supplied immediately on request: by asking us to start now and acknowledging loss of the right to withdraw, you agree the 14-day withdrawal right ends once supply starts (to the extent provided). Goods (e.g., printed photo books): 14 days from delivery to withdraw without reason except for goods made to your specifications or clearly personalized. To withdraw, e-mail [email protected] and return goods within 14 days. Refunds include standard delivery costs of the original shipment, subject to legal conditions.
